Terms and Conditions

TRAVEL CREDITS

Please note that any credits issued are issued by the supplier and not us. Our responsibility to you in connection with the credit is limited to providing reasonable assistance to put future arrangements in place between you and the supplier. Please note that we will not be responsible to you in the event of future supplier failure.

PRICES

All prices are subject to availability and can be withdrawn or varied without notice. The price is only guaranteed once paid for in full by you. Please note that prices quoted are subject to change. Price changes may occur by reason of matters outside our control which increase the cost of the product or service. Such factors include adverse currency fluctuations, fuel surcharges, taxes and airfare increases.

GST

Where applicable, GST is included in the price of domestic travel bookings and services. In accordance with Australian tax law, international travel services (including international airfares and packages) are generally GST-free. Any GST payable will be clearly reflected in your quote or invoice where relevant.

TRAVEL INSURANCE

We strongly recommend that you take out appropriate travel insurance to cover your travel arrangements. Travel insurance is also strongly recommended by the Department of Foreign Affairs and Trade for all overseas travel. Your insurance protection should include cover for cancellation, medical and repatriation expenses, personal injury and accident, death and loss of personal baggage and money and personal liability insurance. Please advise if you require a quote. You must read the Combined Financial Services Guide/Product Disclosure Statement before you decide to buy the travel insurance product you are considering purchasing to ensure it meets your needs and financial situation. The Combined FSG/PDS also contains information about the conditions, limits and exclusions that apply to the insurance.

PASSPORTS & VISAS

All travellers must have a valid passport for international travel and many countries require at least 6 months validity from the date of return and some countries require a machine-readable passport. When assisting with an international travel booking, we will assume that all travellers on the booking have a valid Australian passport. If this is not the case, you must let us know. It is important that you ensure that you have valid passports, visas and re-entry permits which meet the requirements of immigration and other government authorities. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility. If you need information regarding visas, passports and other travel document requirements for your trip, we can assist you with providing information. Visas remain the responsibility of the passenger at all time.

ACCURACY OF INFORMATION

It is your responsibility to ensure that all names, dates of birth and other personal details provided to us for booking purposes exactly match your passport or relevant travel documents. HollyDay Travel is not responsible for any fees, denied boarding, or additional costs arising from incorrect information provided by you. Fees may apply for corrections requested after a booking is confirmed.

TRAVEL ADVICE AND HEALTH REQUIREMENTS

We recommend that you contact the Department of Foreign Affairs and Trade or visit their website at www.smartraveller.gov.au for general travel advice, as well as specific advice (including safety alert levels) relating to the destination you wish to visit. You can also register your travel plans with DFAT, so that you may be more easily contacted in an emergency.

We strongly recommend that you familiarise yourself with the current entry, health, vaccination and border requirements for your destination(s), including any requirements relating to transit countries. These requirements can change with little or no notice.

You should also familiarise yourself with airline requirements around passenger safety and any documentation, testing or health declarations that may be required for transit or final destination travel. This information is subject to change without notice, so we recommend you check the relevant airline and government requirements at the time of booking, as you approach your travel date, and immediately before travel.

You acknowledge that international and domestic travel may carry inherent health and safety risks, including exposure to infectious diseases, and that government and airline requirements relating to these risks may change at any time. It is your own responsibility to acquaint yourself with all relevant travel information, including applicable health risks and requirements. You acknowledge that your decision to travel is made based on your own consideration of this information, and you assume responsibility for the risks associated with travelling. To the fullest extent permitted by law, we accept no liability in relation to these risks.

HEALTH

You must ensure that you are aware of any health requirements and recommended precautions relevant to your travel booking and ensure that you carry all necessary vaccination documentation. In some cases, failure to present required vaccination documentation (e.g. proof of Yellow Fever vaccination) may deny you entry into a country. We recommend that you consult with your local doctor, travel medical service or specialist vaccination clinic before commencing your travel. General health advice for the destination you wish to visit is also available from DFAT (see www.smartraveller.gov.au).

Whether any medical requests can be accommodated, including (without limitation) access to power, refrigeration and travelling with the use of mobility aids, is subject to the travel service provider in their sole and absolute discretion, and will often depend on a number of factors, including (without limitation) any modes of transport and local standards at the destination. All medical requests are beyond our control. While we will include all medical requests as a file note to the travel service provider, we cannot guarantee that your request will be accommodated. It is your responsibility to follow up with the travel service provider directly either at the destination or prior to travelling where possible.

VACCINATIONS

When travelling overseas we strongly recommend you seek medical advice regarding any vaccinations or preventative medication that may be required or mandatory for your journey. We recommend that you consult with your local doctor, travel medical service or specialist vaccination clinic before commencing your travel.

PAYMENT DETAILS

The standard price for all bookings is as quoted or displayed at the time of booking. Payment is accepted by direct deposit, PayID, or credit card (Visa, Mastercard, American Express), all at the standard quoted price with no separate surcharge.

A discount is available for customers who choose to pay by direct bank transfer or PayID. Where applicable, the discount amount will be clearly shown on your quote and/or invoice prior to payment. This discount reflects a saving passed on for the use of a lower-cost payment method and does not affect the standard price payable by any other payment method.

VARIATION OF PAYMENT TERMS

HollyDay Travel reserves the right to update its accepted payment methods and vary payment terms, including in response to changes in card scheme rules, payment processing costs, or regulatory requirements. Where such changes affect an existing booking, HollyDay Travel will provide reasonable notice to the customer.

DEPOSITS/FINAL PAYMENTS

Subject to your rights under the Australian Consumer Law, all deposits are non-refundable for changes of mind or cancellations by you, or if the travel service provider's terms and conditions provide that your deposit is non-refundable. If your deposit is refundable, this is subject to HollyDay Travel having received the funds from the travel service provider and/or being authorised by the travel service provider to refund your deposit. A deposit will secure your booking/seat, however prices quoted may change before you make the final payment. Final payment is required no later than 6 weeks prior to departure unless otherwise stated. Some airfares or services must be paid in full at the time of booking.

CANCELLATION FEES

Should your reservation be cancelled, HollyDay Travel will charge a cancellation fee of a minimum of $300 per person, per booking, in addition to any fees charged by the relevant airline, hotelier, tour operator, wholesaler, ground operator or other travel service provider. This cancellation fee applies to all bookings, whether Domestic, Trans-Tasman or International.

The final HollyDay Travel cancellation fee may be higher than the minimum amount and will be assessed on a booking-by-booking basis, having regard to the reasonable direct and indirect costs, time and work involved in providing booking and advisory services and in processing and managing the cancellation. Any cancellation fee charged by HollyDay Travel will be reasonable and proportionate to the costs and work involved and is subject to your rights under the Australian Consumer Law.

AMENDMENTS

Any changes to a confirmed, deposited or finalised booking prior to departure will attract an amendment fee, plus any communications costs incurred in securing further bookings (of lesser value). Airlines, tour operators, wholesalers, hoteliers, etc. may charge further amendment fees which are in addition to the agency amendment fee.

  • Changes to Domestic/Trans-Tasman bookings will incur a fee of $30 per passenger, per booking, in addition to supplier fees.

  • Changes to International bookings (excluding Trans-Tasman bookings) will incur a fee of $75 per passenger, per booking, in addition to supplier fees.

These amendment fees reflect the reasonable, direct and indirect costs, time and effort involved in providing booking and advisory services to you, as well as processing and managing changes to your booking.

FORCE MAJEURE

HollyDay Travel will not be liable for any failure to perform, or delay in performing, any obligation where this is caused by circumstances beyond our reasonable control, including but not limited to natural disasters, extreme weather, industrial action, war, terrorism, epidemic or pandemic, government intervention, or airspace/border closures.

CONSUMER GUARANTEES

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you under the Australian Consumer Law or any other applicable law that cannot be excluded, restricted or modified by agreement.

FINANCIAL ARRANGEMENTS

We receive remuneration through commissions, financial incentives and other means (together, "financial arrangements") from booking travel and travel-related products and services on your behalf with third party travel service providers. We are not required by law to disclose the nature or value of these financial arrangements.

AGENCY

We act as an agent for, and sell various travel related products as agent on behalf of, numerous transport, accommodation and other service providers, such as airlines, coach, rail and cruise line operators, as well as all of our wholesalers. Any booking, advisory and other services (such as processing a change or cancellation with the relevant travel services provider) that we provide to you are collateral to that agency relationship. Our obligation to you is to (and you expressly authorise us to) provide booking and advisory services, including making travel bookings on your behalf and arranging relevant contracts between you and travel service providers. We exercise care in the selection of reputable travel service providers, but we are not ourselves a provider of travel services and have no control over, or liability for, the services provided by third parties. All bookings are made on your behalf subject to the terms and conditions, including conditions of carriage, cancellations policy and limitations of liability, imposed by these travel service providers. We can provide you with copies of the relevant travel service provider terms and conditions on request. Your legal rights in connection with the provision of travel services are against the specific travel service provider and, except to the extent a problem is caused by fault on our part, are not against us. Specifically, if for any reason (excluding fault on our part) any travel service provider is unable to provide the services for which you have contracted, your rights are against that provider and not against us.

SPECIAL REQUESTS

Please advise if you have any requests that you would like submitted to the airline and hotel/s. Please note that these would be on a request basis only.

FLIGHT TIMES

All flight times shown are local times at destination and are in 24 hour time.

BAGGAGE ALLOWANCE

Please ensure you read your travel documents carefully for details on baggage allowances as these can vary from airline to airline and country to country. Excess baggage (if your airline allows it) can be expensive and is your responsibility. We will not be liable for any expenses, fees, penalties, costs, liabilities, damages or losses associated with baggage allowances and excess baggage.

COMPLAINTS

If you have a complaint about the services provided by HollyDay Travel, please contact us directly so we can work to resolve it. Complaints regarding third-party travel service providers, such as airlines, hotels, or tour operators, should be directed to that provider in the first instance, and we can assist in facilitating this where appropriate.

ACCEPTANCE OF TERMS

By making a booking, paying a deposit, or engaging HollyDay Travel to arrange travel services, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions on behalf of yourself and all travellers named in the booking.

GOVERNING LAW

These Terms and Conditions are governed by the laws of South Australia, and the parties submit to the non-exclusive jurisdiction of the courts of South Australia.
